Acerca del Colegio Dominicano de Notarios

The Dominican College of Notaries serves as a public moral institution, established and governed by Law 140-15, enacted on August 7, 2015. Since its inception in 1967, the College has committed itself to transparency, the professionalization of notary public activities, and the defense of these vital services. Located at 501 W Broadway Ste 17, San Diego, CA 92101, the College also maintains branches throughout the United States. It offers notarial security paper, a directory of notaries, continuing education via ECANOT, and a cooperation program through NOTACOOP, among various other initiatives. The promotion of legal security and the professionalization of the legal field are integral to all of our endeavors.

Awhile ago my general counsel and friend Eric Ranisau (@EJR123) alerted me to an important dispute taking place between an entertainment law blog and the Jim Henson Company. The dispute is in regards to the Henson Company taking down a blog post from Matthew Nixon’s Word Moxie blog. It’s a long story with back and forth between Matthew Nixon’s indictment against the Henson Company, Eric Sherman’s objections, and the lawyers for each party electronic trading complaints.

In looking for updates on the dispute I found this from Eric Sherman about the withdrawal of the dispute between the parties: This morning, I was tipped off that there had been significant developments in Sherman v. Nixon. When I logged on to Lexis this morning I discovered that all briefs in that case had been withdrawn without prejudice and the case closed.

Seems like there could easily be issues with bloggers taking down blog posts as well as disputes with TOS agreements being enforced vs 1st amendment rights.

The Website of the Dominican College of Notaries provides the following services: maintenance of a constantly updated directory of notaries, provision and issuance of notarial headquarters paper, dissemination and provision of information regarding notarial transparency, other cooperative services through NOTACOOP, provision of continuing education through ECANOT, dissemination of legal publications, news and events, advisory and guild defense services for notaries. The availability of some services is subject to limitation with respect to user category and territory. The College may at its discretion modify, suspend or remove any service provided through this Website.

Users consent to access and use the Website and its services for only lawful purposes. Users may not do any of the following when using the Website:

  • Upload or transmit any material that contains software viruses, worms, Trojans or any other computer code or programs which will destabilize, damage, intercept, harm or interfere with the Website, the Website Content, our or another’s computer systems, data networks or security measures;

Membresías, Tarifas y Condiciones de Pagos

Membership as a member of the Dominican College of Notaries affords our notaries and other duly qualified professionals with access to exclusive benefits, privileges and educational opportunities. Membership dues, service fees and related payment policies are set forth in the College’s internal bylaws and policies and may vary from time to time. Members should pay all related fees by their respective due dates. Where there is failure to make payments or to observe conditions of membership, access to member services may be temporarily suspended or terminated.

“The Dominican College of Notaries shall make continuing education available through its ECANOT school. It may offer courses, workshops and certification programs. In order to effectively deliver its educational programs, registration, payment of fees, and other program requirements may be required. The College may issue certificates and statements of completion but may change or discontinue education courses and activities without notice.”

Participation in NOTACOOP is subject to additional terms and eligibility conditions. Consult these terms upon request. The Website provides access to various publications, legal instruments, decisions, news items and notices about the notarial community. Some documents may be available without restriction but others may only be accessible to members or other registered users. While the College tries to keep all information up-to-date, users must independently verify the status and pertinence of legal instruments.

Servicio de Asesoría y Defensas de gremio

It is one of the mandates of the Dominican College of Notaries to defend and represent notaries’ interests before public and private bodies. This representation and defence is provided through the services offered by the College, such as advisory services or guild defence. As part of this process, users requesting representation or advisory help are obliged to do so according to internal procedures and laws, and may have to provide documents or proof of membership.

La prestation de services-conseils ou la défense corporative est fourni par le Collège conformément aux procédures internes et à la législation applicable. Toute personne désireux d’obtenir la représentation ou le service-conseil devra obligatoirement passer aux voies officielles et, être dans l’obligation de présenter des documents, et/ou de prouver son appartenance au Collège.

Limitación de Responsabilidad

To the fullest extent permitted by law, Dominican College of Notaries and its board of directors, officers, employees, members, affiliates and agents shall not be liable to you for any injury, loss, claim, damage or any direct, indirect, consequential, punitive or special damages of any nature whatsoever arising from or related to your use of the Website, the services or materials contained therein. This includes but is not limited to loss of profits, data, goodwill or business interruption. Some jurisdictions do not permit the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, and as such these provisions may not apply to you.
